admitted the incident occurred; however, did not observe when child # 1 initiated the inappropriate contact with child # 2. Staff must provide supervision at all times. This is a Type A deficiency and it poses an immediate risk to the health and safety to the children in care. An immediate civil penalty in the amount of $500 dollars was assessed as of result of the absence of supervision.

The plan should entail their process to ensure children are observed at all times. Director shall institute a plan to ensure children are supervised at all times while using the restroom and provide training to all Staff concerning the new routine to prevent similar incidents reoccurring in the future. The plan must be submitted to the department no later than 1/19/2023.
