Based on observation, the center did not comply with the section of the regulation cited above because staff did not ensure safe sleep practices for infants in care. LPAs observed one infant sleeping in a sleep sack. LPAs also observed another infant sleeping in an oversized pajama set; Because the pajama was oversized, the infant’s legs could not reach the designated leg openings, and the excess fabric was positioned so that the garment functioned like a sleep sack and was tucked underneath the child. As a result, the infant’s legs were trapped inside the pajamas, restricting free movement. These conditions pose/posed a potential health and safety risk to children in care.

The director agrees to immediately review and implement safe sleep procedures with all staff. The facility will ensure that infants are dressed in properly fitted sleep clothing that does not restrict movement or pose entrapment hazards. Staff will conduct safe sleep refresher training and submit proof of completion to LPAs by the due date. A return visit will be conducted to verify the correction.
