Based on observation, the licensee did not comply with the section cited above in that there was no gate on the stairs leading to the second level which poses/posed a potential health, safety or personal rights risk to persons in care.

The licensee corrected the deficiency at the time of the inspection by placing a baby gate on the stairs. LPA reminded the licensee that the baby gate needs to be placed on the stairs when there are day care children present who are under the age of 5 years old.
