Based on observation, interview, record review, the licensee did not comply with the section cited above in, the licensee failed to associate a subject staff after the hire date on 01/28/2021 and the subject staff was observed to be present and caring for 4 children at the facility, which poses an immediate health, safety or personal rights risk to persons in care.

The licensee agrees to submit a LIC9182 Criminal Background Clearance Tranfer Request to the department, to ensure the subject staff is eligible cleared to work with children at the facility. Also, the licensee agrees to submit a written statement of understanding regarding the regulation cited, to ensure, all individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility complete a criminal record background check or complete a criminal record transfer.
