Based on observation, interview, and record review, the licensee did not comply with the section cited above due to caring for 13 children at one time when more than 3 infants were present. This poses an immediate health, safety, or personal rights risk to persons in care.

Licensee stated that they will ensure that either their children will leave the facility prior to opening, or they will track arrivals to ensure no more than 3 infants are in care whenever more than 12 children are present.
