Based on observation, the licensee did not comply with the section cited above in, LPA observed a pond located in the back yard of the home. Pond is not in compliance with Title 22 regulation. fence is not 5ft tall, gate did not swing away from the pond, was not self-closing and did not have a self-latching device located no more than six inches from the top of the gate. LPA also observed footholds enabling children to climb over and a ladder was also observed laying along the fence making the pond accessible to children which poses an immediate health, safety or personal rights risk to persons in care.
