Based on observation, the licensee did not comply with the section cited above due to upon entering the backyard LPA observed that the gate separating the accessible area in the backyard and the non-accessible area was not fully closed. This resulted in leaving the above ground pool accessible. LPA observed in the backyard that there was a blow-up pool that held approximately 2-inches of water which poses an immediate health, safety or personal rights risk to persons in care.

Licensee immediately flipped the pool completely emptying out the water, closed the gate and stated she will come up with a daily morning checklist that includes making sure the wading pool is empty before the start each day. Licensee will submit the morning checklist to CCLD by POC deadline on 6/15/2026 by letter or email to LPA.
