(4) The maximum group size, with two teachers, or one fully qualified teacher and one aide, does not exceed 12 toddlers. This requirement was not met as evidenced by: Based on record review the Early Montessori program was out of ratio on 12/01/2025, 12/03/2025 and 12/05/2025.

This requirement is not met as evidenced by: LPA observed one substitute teacher that was in the Early Montessori program and after interview with Site Director, Marija Palihnic Fisher it was revealed that one substitute was not associated in the Guardian background check system utilized by the Department of Social Services.

Site Director, Marija Palihnic Fisher collected the one substitue Drivers License and found they had an eligible clearance and associated them to the facility in the Guardian Background Check System on 01/26/2026. Site Director provided a statement during the investigation regarding her understanding of the criminal background check process. Also, LPA Jaime Gonzales informed the Site Director, Marija Palihnic Fisher to provide a copy of this licensing report dated that 01/26/2026 documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Site Director, Marija Palihnic Fisher. Appeal Rights Provided. A notice of site visit was given and must remain posted for 30 days. Based on interveiw and record review the licensee did not comply with the section cited above in Staff (S2 and S3) do not have criminal record clearance associations to Canyon Heights Academy and (S4) has not completed a new criminal record clearance fingerprint live scan which poses an immediate health, safety or personal rights risk to persons in care.

Additionally, plan will include how director will contact Guardian to gain access to her account, contact her information technology representative regarding her website access, and how she will prevent this from occuring in the future.
