Based on observation and record review, the licensee did not comply with the section cited above. During today’s inspection , LPA Garcia observed Staff 1 (S1) providing direct care and supervision to four children. Upon review, LPA determined that S1 did not have a criminal record clearance or exemption on file prior to the individual’s employment or initial presence in the child care facility, as required by regulation. This constitutes the presence of an uncleared adult in the facility while children were in care. which poses an immediate health, safety or personal rights risk to persons in care.

The director will review hiring procedures with administrative staff and implement a verification step requiring confirmation of criminal record clearance prior to scheduling or allowing any adult to be on site. The director agrees to maintain documentation of all staff clearances and ensure ongoing compliance with Title 22 requirements. The director will also submit a written statement to the LPA describing how the issue has been mitigated and outlining the steps taken to prevent recurrence.
